Consideró que tienen carácter "remunerativo" y, por ese motivo, los contempló en el cálculo de indemnización de una trabajadora despedida. Los jueces Estela Ferreirós y Néstor Rodríguez Brunengo, de la Sala 7ª, se pronunciaron así ante el reclamo por diferencias salariales en la indemnización por despido de una empleada de una empresa de tarjetas de crédito. Lo interesante es que este fallo se conoce en momentos en que la Justicia federal inició una investigación a raíz de un presunto intento de soborno al diputado Héctor Recalde, quien denunció que representantes de algunas empresas de tickets le pidieron que alterara la evolución de un proyecto de ley referido a ese beneficio. Los camaristas subrayaron que "salario significa remuneración o ganancia, sea cual fuere su denominación o método de cálculo, siempre que pueda evaluarse en efectivo, debida por un empleador a un trabajador en virtud de un contrato de trabajo escrito o verbal". En ese contexto, argumentaron que "la prestación (ticket canasta) puede incluir en esa definición de salario". Tras invocar tratados internacionales en materia laboral, los camaristas señalaron: "En suma, lo que se remunera, no puede ser 'no remuneratorio'". "Efectivamente los ticket canasta –que perciben 1,6 millones de trabajadores en todo el país- forman parte de la remuneración del trabajador", concluyeron los jueces en su fallo. El documento recuerda que la Corte Suprema ya se había pronunciado en similares términos en una causa de 1998, con su antigua composición de la "mayoría automática" en tiempos del gobierno de Carlos Menem.
